1. Introduction & acceptance

These Terms govern your access to and use of the websites, control panel, hosting, domains, email and related services (together, the "Services") provided by HostFilya ("HostFilya", "we", "us" or "our"). By creating an account, purchasing a plan or otherwise using the Services, you agree to be bound by these Terms and by any policies referenced here, including our Privacy Policy. If you do not agree, you must not use the Services.

If you are entering into these Terms on behalf of a company or other organisation, you represent that you have authority to bind that organisation, and "you" refers to that organisation.

2. Accounts & eligibility

To use most Services you must register for an account. You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract. You agree to provide accurate, current and complete information and to keep it up to date.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at support@hostfilya.com if you suspect any unauthorised use. We recommend enabling two-factor authentication where available.

3. Acceptable use policy

You agree to use the Services lawfully and responsibly. You must not use the Services to host, store, transmit or link to any of the following, and you must not assist others in doing so:

  • Content that is illegal, infringes intellectual property or violates the rights of others;
  • Malware, viruses, phishing pages, or other malicious or deceptive code;
  • Unsolicited bulk email (spam), or activities that result in our IP addresses being blacklisted;
  • Child sexual abuse material, or content that exploits or endangers minors;
  • Content that is defamatory, harassing, threatening, or promotes violence or hate;
  • Attempts to gain unauthorised access to systems, networks or data, including port scanning, brute-forcing or denial-of-service attacks;
  • Cryptocurrency mining, torrent trackers, or other activities that place a disproportionate load on shared infrastructure;
  • Any activity that disrupts, degrades or interferes with the Services or other customers.

We may investigate suspected violations and may remove content or suspend Services that we reasonably believe breach this policy.

4. Plans, billing & renewals

Paid plans are billed in advance on the cycle you select (for example, monthly or annually). Prices are shown at checkout and may exclude applicable taxes. Promotional and introductory rates apply only to the initial term stated at purchase.

Unless you cancel before the end of the current term, plans renew automatically at our then-current standard renewal rate, and you authorise us to charge your payment method on file. We will send a renewal reminder before each renewal where required. It is your responsibility to keep your payment details valid and current.

5. Refunds & 30-day money-back guarantee

Most new shared, WordPress and VPS hosting plans are covered by a 30-day money-back guarantee. If you are not satisfied, contact us within 30 days of your initial purchase for a refund of the hosting fee.

The guarantee does not cover domain registrations and renewals, dedicated servers, add-on products, administrative or setup fees, or charges incurred after the first 30 days. Renewals are generally non-refundable. Refunds are issued to the original payment method.

6. Uptime SLA & service credits

We target 99.9% network uptime in any given calendar month, measured by our monitoring systems. If we fail to meet this target and you are in good standing, you may request a service credit for the affected month.

Service credits are calculated as a percentage of that month's hosting fee and are your sole and exclusive remedy for downtime. The SLA excludes scheduled maintenance, emergency maintenance, issues outside our reasonable control, and downtime caused by your own content, code or configuration. Credits must be requested within 30 days of the incident.

7. Cancellation & suspension

You may cancel your plan at any time from your control panel or by contacting support. Cancellation stops future renewals; it does not entitle you to a refund of fees already paid except as described in the money-back guarantee above.

We may suspend or terminate your access, with or without notice, if you breach these Terms, fail to pay amounts due, or engage in activity that poses a risk to the Services or other customers. Where practical, we will give you an opportunity to remedy a breach. On termination, your right to use the Services ends and we may delete your data after a reasonable period.

8. Intellectual property

The Services, including our software, control panel, documentation, trademarks and branding, are owned by HostFilya or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

You retain all rights to the content you upload and host. You grant us the limited rights necessary to store, transmit and display that content solely to operate and provide the Services to you.

9. Limitation of liability

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind. We do not warrant that the Services will be uninterrupted, error-free or completely secure.

To the extent permitted by law, HostFilya will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the amount you paid us for the Services in the three months preceding the event giving rise to the claim. You are responsible for maintaining your own backups of important data.

10. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through the control panel. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
